Trademark Application Template for a Clothing Brand
Class 25 apparel + 35 retail services template.
When to use this template: Use when filing for an apparel brand. Class 25 covers the clothing items themselves; class 35 covers online or in-store retail of those items.
# Trademark application: [BRAND NAME] ## Mark [BRAND NAME] -- [wordmark | logo] ## Filing classes - **Class 25** (clothing) - **Class 35** (online retail of clothing -- optional but recommended for D2C brands) ## Goods / services description (Class 25) > Clothing, namely, t-shirts, sweatshirts, pants, jackets, hats, and socks. *(Edit this list to match exactly what you sell. Do NOT use "and the like" or "etc." -- USPTO will reject vague IDs.)* ## Goods / services description (Class 35) > Online retail store services featuring clothing. ## Specimen guidance - For Class 25: a photo of a hangtag, woven label, or screen-printed label on the garment showing the mark. A photo of the marketing-only website is NOT a Class 25 specimen. - For Class 35: a screenshot of your online store showing the mark in the header AND a product page with an Add to Cart button. ## Filing basis - [ ] 1(a) -- in use in commerce (preferred) - [ ] 1(b) -- intent to use ## Notes - Class 25 is one of the most-rejected classes for vague IDs. List the SPECIFIC garment types you make. - If you only sell through a third party (Etsy, Amazon), the Class 35 retail services may not apply -- that retail service is being provided by Etsy / Amazon, not you.
